Hold up, Facebook! Have you forgotten about the Fair Housing Act in the Civil Rights Act of 1968 that clearly states refusing to sell a home to a buyer based on their race is illegal? Facebook has given homeowners that ability to filter specific demographics from viewing their housing ads through a new feature titled “Ethnic Affinities.”

Multicultural targeting is designed to target a more diverse demographic — but when you’re filtering out those exact ethnicities that could create that image for you, is that not counterproductive? Facebook justifies allowing the controversial filter to be an option for users to take advantage of by arguing that it is a common tactic used in the advertisement industry and is protected by the Communications Decency Act against any liability for discrimination. But Facebook, do not let us revert back to our old ways. If you are unaware of what they are, let’s take a trip down memory lane.

Shelley v. Kraemer is a famously known court case that took place in St. Louis, Mo. The Shelleys, an African-American family, tried to purchase a home in St. Louis that was in a predominantly caucasian neighborhood.

Kraemar fought to keep the Shellys out of the neighborhood. Later, President Lyndon B. Johnson signed the “Fair Housing Act of 1968, [that stated] it’s illegal ‘to make, print, or publish, or cause to be made, printed, or published any notice, statement, or advertisement, with respect to the sale or rental of a dwelling that indicates any preference, limitation, or discrimination based on race, color, religion, sex, handicap, familial status, or national origin,'” according to an article on ProPublica.
